Governing Law: Delaware, United States (primary); Australian Privacy Act 1988 (Cth); EU/UK GDPR; and applicable laws in all jurisdictions in which FindPlay operates, including the United States, Australia, the European Union, the United Kingdom, and Asia-Pacific markets.

These Event Terms and Conditions govern the relationship between FindPlay, Play Providers who list events on the platform, and users who register for or attend events facilitated through FindPlay. These terms apply globally and must be read alongside FindPlay's Terms of Service, Cancellation and Refund Policy, and Event Code of Conduct.
Event means any activity, class, competition, workshop, session, camp, or gathering listed on FindPlay for which registrations, bookings, or tickets are available through the platform.
Event Organiser means the Play Provider who has listed the Event on FindPlay and is responsible for its delivery.
Attendee means any user who has registered for or purchased a ticket to an Event through FindPlay.
FindPlay means FindPlay, Inc. (EIN: 36-5170181), the platform operator.
FindPlay acts as a marketplace intermediary that facilitates the connection between Event Organisers and Attendees. FindPlay is not itself the organiser of Events listed on the platform. The contract for attendance at an Event is between the Attendee and the Event Organiser. FindPlay is not a party to that contract except to the extent that it facilitates payment processing and provides platform services.
This distinction is recognised under applicable law in all of FindPlay's operating jurisdictions, including under the EU Digital Services Act (DSA) marketplace provisions, the Australian Consumer Law (ACL) intermediary framework, and equivalent US and APAC regulatory frameworks.
Event Organisers are responsible for the accuracy and completeness of all information in their Event listing, including:
Event title, description, format, and program.
Date, time, duration, and location (or virtual platform details).
Participant eligibility requirements, including age, skill level, or fitness prerequisites.
Equipment or attire requirements.
Pricing, including all applicable taxes and fees.
Cancellation and refund terms (which must meet or exceed FindPlay's minimum Cancellation and Refund Policy standards).
Any health, fitness, or medical requirements or contraindications.
Whether the Event involves contact, physical risk, or outdoor activity.
FindPlay reserves the right to remove, suspend, or require amendment of any Event listing that is inaccurate, misleading, or in breach of these terms or FindPlay's platform policies.
Registrations for Events are processed through FindPlay's booking system. A booking is confirmed when:
The Attendee has completed the registration process, including payment where applicable.
The Event Organiser has not cancelled or closed the Event prior to confirmation.
FindPlay has issued a booking confirmation to the Attendee.
Confirmed bookings are subject to the Event Organiser's cancellation and refund policy as displayed at the time of booking, subject to FindPlay's minimum standards and applicable consumer law.
By registering for an Event through FindPlay, Attendees agree to:
Provide accurate information in their registration, including any required health or eligibility disclosures.
Comply with FindPlay's Event Code of Conduct at all times.
Comply with the Event Organiser's reasonable event-specific rules and instructions.
Arrive on time and prepared for the Event.
Ensure that any equipment they bring meets the safety standards required for the activity.
Not attend if they are unwell in a manner that could affect the safety of other participants (including communicable illness).
Participation in sport and fitness activities involves inherent physical risk. Attendees acknowledge that:
They have assessed their own fitness and health to participate in the Event.
They have disclosed any medical conditions, injuries, or contraindications to the Event Organiser where requested.
FindPlay and the Event Organiser are not responsible for injuries arising from the inherent risks of physical activity, provided that reasonable safety standards have been met.
The extent to which liability can be contractually limited varies by jurisdiction:
Australia: Liability for death or personal injury caused by negligence cannot be excluded under the Australian Consumer Law. Voluntary assumption of risk waivers are subject to the Consumer Guarantees under the ACL and applicable state legislation.
United States: Liability waivers are governed by applicable state law and vary significantly by state. Some states (e.g., Virginia, Louisiana) do not enforce pre-injury liability waivers. Attendees should review any waiver carefully.
United Kingdom: The Unfair Contract Terms Act 1977 and Consumer Rights Act 2015 restrict the extent to which liability for negligence can be excluded in consumer contracts.
European Union: Consumer protection directives restrict unfair contract terms, including liability exclusions. The EU Consumer Rights Directive (2011/83/EU) applies to event bookings.
Singapore: The Unfair Contract Terms Act (Cap. 396) restricts exclusion of liability for negligence.
Japan: The Consumer Contract Act restricts clauses that entirely exclude an operator's liability for damage caused by the operator's negligence.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
If an Event is cancelled by the Event Organiser:
All Attendees are entitled to a full refund of fees paid through FindPlay, inclusive of any booking fees charged by FindPlay.
FindPlay will process refunds within 5–10 business days of the cancellation being confirmed.
Where applicable consumer law provides stronger refund protections (including the EU Consumer Rights Directive, Australian Consumer Law, UK Consumer Rights Act 2015, and applicable US state statutes), those protections apply.
Event Organisers who cancel an Event with less than 48 hours' notice without reasonable cause (e.g., force majeure, severe weather, public health emergency) may be subject to penalties under FindPlay's Waitlist and No-Show Policy.
Attendee cancellations are governed by the Event Organiser's cancellation policy as displayed at the time of booking. FindPlay's minimum Cancellation and Refund Policy standards apply as a floor.
If an Event Organiser makes a material change to an Event after registrations have been accepted (including a change to date, time, location, format, or program), Attendees will be notified and offered the option to withdraw for a full refund. Material changes made less than 48 hours before the Event start time are treated as equivalent to a cancellation for refund purposes.
Event pricing displayed on FindPlay is inclusive of any applicable goods and services tax (GST) in Australia, value added tax (VAT) in the EU and UK, and other applicable sales or consumption taxes, unless otherwise stated. Tax obligations in respect of Event revenue rest with the Event Organiser. FindPlay collects and remits applicable taxes where required by law and in accordance with its tax compliance obligations in each jurisdiction.
Event Organisers retain ownership of all intellectual property in their Event content, programs, and materials. By listing an Event on FindPlay, Event Organisers grant FindPlay a non-exclusive licence to display Event content on the platform for the purposes of promotion and facilitation.
Attendees must not record, reproduce, or distribute Event content (including coaching instruction, training programs, or session content) without the express permission of the Event Organiser.
These terms are governed by the laws of the State of Delaware, United States, subject to mandatory consumer protection laws applicable in the Attendee's jurisdiction. Disputes between an Attendee and an Event Organiser should be directed to the Event Organiser in the first instance. If unresolved, disputes may be submitted to FindPlay's dispute resolution process at legal@findplay.com.
EU Attendees may also access the EU Online Dispute Resolution (ODR) platform. Australian Attendees may contact the relevant state consumer protection authority or the ACCC. UK Attendees may contact the Citizens Advice Bureau or relevant trading standards authority.
